Jonathan A. Patchen is a founder and partner at Taylor & Patchen, where his practice focuses on complex civil litigation, trials, and arbitrations. Jonathan has substantial experience in disputes regarding trade secrets and other intellectual property, breach of contract, breach of fiduciary duty, partnership and corporate governance, and professional liability. He has first-chaired bench and jury trials in federal and state court, arbitrated multi-million dollar disputes, and briefed and argued cases on appeal.

Jonathan is deeply involved in the Bay Area legal community. He is currently Chair of the Judiciary Committee of the Bar Association of San Francisco and a member of the Executive Committee of the Litigation Section of the State Bar of California. He has served as the Chair of the Litigation Section of the Bar Association of San Francisco and Vice President of the Harvard Law School Association, Northern California Chapter. 

Jonathan’s publications include What You Need to Know About the Defend Trade Secrets Act of 2016, Abovethelaw.com (June 9, 2016), and The Black Box Speaks: Juror Questions in the Hyper-Information Age, ABTL Report, v.22 no. 3 (Winter 2013).

Prior to joining Taylor & Patchen, Jonathan worked as an attorney at Covington & Burling LLP and clerked for Judge Ronald M. Gould of the Ninth Circuit Court of Appeals. He graduated magna cum laude from Harvard Law School and with a B.S. in Economics and B.A. in Political Science from the University of Wyoming, where he was elected to Phi Beta Kappa.

Jonathan is admitted to practice in California and New York as well as the Ninth Circuit Court of Appeals and the federal district courts for the Northern, Eastern, Central, and Southern Districts of California.

Representative Matters

Incyte Corp. v. Flexus Biosciences, Inc., et al., No. N15C-09-055 (Del. Super. Ct.) (pending) (representing founders of Flexus Biosciences in defense of trade secret misappropriation claim where Plaintiff claims $2.5 billion in damages).

Wang v. Palo Alto Networks, Inc., et al., No. 12-5579-WHA (N.D. Cal.) (represented co-founder of Palo Alto Networks in defense of trade secret misappropriation and patent infringement claims; successfully moved and argued for summary judgment on trade secret misappropriation claim, 2014 WL 1410346).

AMC Technology, LLC v. Cisco Systems, Inc., No. 11-3403-PSG (N.D. Cal.) (lead counsel for plaintiff in breach of contract dispute; matter satisfactorily resolved following multi-day pretrial conference and motion hearing).

E-Smart Technologies, Inc. v. Drizin, et al., No. 06-5528-MHP (N.D. Cal.) (appointed by Court to represent Northern District of California in civil contempt proceedings; lead trial counsel for multi-day bench trial that resulted in finding of civil contempt, 2011 U.S. Dist. LEXIS 53129).

McDonald v. Krook, et al., No. 108-CV-126702 (Santa Clara Super. Ct.) (defended pre-merger and post-merger company, CEO and CFO in claims including breach of contract, breach of fiduciary duty, and constructive fraud; prevailed on summary judgment and obtained six-figure fee award for clients).
