Josh Benson is Special Counsel at Taylor & Patchen, where his practice focuses on civil appellate litigation, including commercial disputes, professional responsibility and legal ethics, and plaintiff-side matters.

He has argued several cases before the California Court of Appeal and authored briefs to the California Supreme Court and the Ninth Circuit Court of Appeals. His appellate experience includes pro bono work for the Family Violence Appellate Project, the ACLU of Northern California, and the Bar Association of San Francisco.

Prior to joining Taylor & Patchen's predecessor firm, Taylor & Company, Josh worked as a volunteer attorney at Bay Area Legal Aid and clerked for Judge A. Wallace Tashima of the Ninth Circuit Court of Appeals. He graduated first in his class from UC Berkeley School of Law (Boalt Hall), where he was a member of the California Law Review and awarded Order of the Coif. Prior to law school, Josh worked as a speechwriter and policy advisor in Democratic politics and as a political journalist at The New Republic in Washington, D.C. He graduated from Stanford with degrees in biology and political science.

Josh is a member of the California State Bar and is admitted to practice before the United States Court of Appeals for the Ninth Circuit and the United States District Court for the Northern District of California. Josh is also a member of the San Francisco Trial Lawyers Association, the California Employment Lawyers Association, and the Association of Business Trial Lawyers.

Representative Matters

Bean v. Pacific Coast Elevator Corp., 2015 Cal. App. LEXIS 218 (2015) (affirming all but $10,000 of a $1.3 million judgment for personal injuries arising from a car accident in San Diego).

Nevarez v. Tonna, 227 Cal. App. 4th 774 (2014) (affirming domestic violence restraining order and clarifying law on the evidentiary showing for relief).

Salas v. Sierra Chemical Co., 59 Cal. 4th 407 (2014) (amicus) (authored amicus brief that the Supreme Court substantially adopted in holding that undocumented workers have remedies under FEHA for employment discrimination).

UTHE Technology Corp. v. Aetrium, Inc., 808 F.3d 755 (9th Cir. 2015) (co-counsel for plaintiff pursuing RICO claims against allegedly fraudulent business partners; successfully obtained reversal of summary judgment that had been granted in favor of defendants).

In re Heller Ehrman LLP Bankruptcy Liquidation, No. 14-16318 (9th Cir. 2015) (pending) (authored amicus brief for BASF and LACBA on the legal ethics implications of allowing a bankrupt law firm to claim a property interest in its former hourly fee matters).
