Max B. Twine is an attorney at Taylor & Patchen, where his practice focuses on complex civil litigation and dispute resolution in matters concerning intellectual property, internal corporate and partnership disputes, and legal malpractice. Max has significant experience litigating misappropriation of trade secret cases and recently co-authored the article, What You Need to Know About the Defend Trade Secrets Act of 2016, Abovethelaw.com (June 9, 2016). Max also advises individuals and employers in the technology sector concerning the protection of confidential and proprietary business information.

Max is a member of the Association of Business Trial Lawyers’ Leadership Development Committee, where he has organized several panel discussions, including “Managing Unconscious Bias” (October 2016), “Getting Into Court: How Junior Attorneys Can Obtain Valuable Courtroom Experience” (August 2015), and “Who’s Your Client? Avoiding Pitfalls in the Representation of Individuals and Entities” (April 2014). Max also served for two years as the Co-Chair of the Leadership Development Committee’s pro bono project.

Prior to joining Taylor & Patchen, Max clerked for Judge Stanley R. Chesler of the U.S. District Court for the District of New Jersey and worked as an attorney at the law firm McCarter & English. Max graduated from Tufts University with a B.A. in Philosophy. Prior to attending law school, he served as Campaign Materials Coordinator for President Barack Obama during his 2004 U.S. Senate Campaign in Chicago, as an Executive Assistant at the Bauman Foundation in Washington, DC, and as a Senior Community Liaison and key member of Brooklyn Borough President Marty Markowitz's communications team. Max received his law degree in 2011 from the University of Virginia School of Law, where he was President of the UVA Law ACLU and a mentor with Action for Better Living Tomorrow.

Max is admitted to practice in California, New York, and New Jersey, as well as the United States District Courts for the Northern and Southern Districts of California and the United States District Court of New Jersey.

Employee Counseling (ongoing) (counseling new employees of pharmaceutical and technology companies concerning their ongoing legal obligations to former employers).

Vintage Pacific Land Company, LLC. v. Coast Range Investments, LLC, et al., No. CGC-14-536639 (San Francisco Super. Ct.) (successfully defeated TRO request and prevailed in arbitration on claims related to real estate partnership dispute).

Wailea Partners, LP v. HSBC Bank USA, N.A., No. CGC-15-547955 (San Francisco Super. Ct.) (obtained dismissal of $16 million claim against bank on statute of limitations grounds).

Pentagon Technologies Group, Inc. v. Michael McKenna, et al., No. RG15771334 (Alameda Super. Ct.) (obtained court order barring individual from competing against former employer based upon allegations of trade secret misappropriation and breach of contract).

ConnectAndSell, Inc. v. Stuart Schmidt, No. CIV526143 (San Mateo Super. Ct.) (defeated three TRO requests and successfully settled takeover action brought by corporate insiders against company CEO).
