Taylor & Patchen Defends Flexus Biosciences in Billion-dollar Trade Secret Misappropriation Case

Taylor & Patchen is pleased to announce that partner Jonathan A. Patchen and attorney Max Baba Twine successfully defended the founders of Flexus Biosciences Inc., Drs. Terry Rosen and Juan Jaen, against a high-profile trade secret misappropriation claim from plaintiff Incyte Corp. After over three years of litigation in which a number of the claims against the Defendants were dismissed following motion practice, a jury of the Superior Court of the State of Delaware rejected Incyte’s remaining trade secret misappropriation claims that could have equated to a nine-figure unjust enrichment award.

“We are thrilled by this victory,” said Patchen. “It was a pleasure to work with the team representing Flexus, and we appreciate the jury’s fair deliberation of the matters at hand.”

The case is Incyte Corp. v. Flexus Biosciences Inc., Terry Rosen and Juan Jaen. Taylor & Patchen represented Drs. Rosen and Jaen; Kirkland & Ellis LLP represented Flexus.
